Vatengi Systems LLC ("Company," "we," "us," or "our")
Operates the vatengi.com B2B sales-intelligence platform (the "Service"). References to "Vatengi" in these documents mean the Service, website, and related applications branded under that name.
This Acceptable Use Policy ("AUP") applies to all customers and users of the Service operated by Vatengi Systems LLC. It supplements and is incorporated into our Terms of Use. Capitalized terms not defined here have the meanings given in the Terms.
1. Scope
This AUP governs your access to Directory Data, use of reveal and export features, CRM integrations, API access, follow-up email sequences, and workspace SMS and voice features (when enabled via Twilio). It applies to all users within your workspace, including administrators and invited members.
2. Lawful outreach requirements
Vatengi is a business contact data platform. We are not a telemarketer and we do not provide National or state Do Not Call registry scrubbing. You must obtain and maintain your own Subscription Account Number (SAN) and scrub phone numbers before telemarketing unless a valid exception applies.
When contacting individuals whose information you obtain through Vatengi, you must:
- TCPA and telemarketing laws
- Obtain prior express consent before using autodialers, prerecorded messages, or SMS to wireless numbers where required; comply with federal and state telemarketing rules.
- Do-not-call registries
- Scrub phone numbers against applicable national and state do-not-call lists before telemarketing, unless a valid exception applies.
- CAN-SPAM and commercial email
- Include accurate header and subject information, a valid physical mailing address, and a clear unsubscribe mechanism; honor opt-out requests within the timeframes required by law.
- GDPR, UK GDPR, and ePrivacy
- Ensure a lawful basis for processing and contacting individuals in the EEA, UK, and Switzerland; honor data subject rights and local B2B marketing rules.
- CCPA/CPRA and U.S. state privacy laws
- Honor opt-out and do-not-sell rights where applicable to your use of contact data.
- Lead consent
- Do not rely on contact data obtained from third-party lists unless you have verified that valid consent was obtained for your specific outreach, including compliance with FCC one-to-one consent requirements where applicable.
3. Permitted use
You may use the Service to:
- Identify and research business prospects for legitimate B2B sales, marketing, and recruiting within your subscription limits.
- Reveal, export, and sync contact information to CRMs and tools used by your organization.
- Send professional outreach through connected mailboxes, SMS, voice, and sequences, provided such outreach complies with Section 2.
4. Prohibited conduct
You may not:
- Send spam, bulk unsolicited messages, harassment, threats, or deceptive communications.
- Impersonate any person or misrepresent your identity or affiliation.
- Scrape, crawl, or harvest the directory outside authorized product features.
- Resell, publish, or license Directory Data to third parties except as permitted under the Terms.
- Bypass credit gates, reveal controls, rate limits, or export restrictions.
- Upload or sync unlawful lead lists or data obtained without proper rights or consent.
- Use the Service to build competing datasets or train models on Directory Data without our written consent.
- Introduce malware, probe systems without authorization, or interfere with Service integrity.
- Use the Service in violation of export control, sanctions, or anti-bribery laws.
5. Follow-up sequences, mailboxes, and Twilio SMS/voice
If you use follow-up sequences or connect an SMTP mailbox, you are the sender of outbound email for legal purposes. You must ensure templates include required CAN-SPAM elements and truthful content. We may block or disable templates or sending that we reasonably believe violates this AUP or applicable law.
When two-way SMS or calling features are enabled through Twilio, your workspace acts as the sender or caller for legal purposes. You must obtain required consent before texting or calling wireless numbers, honor STOP/HELP and do-not-call obligations, identify your organization in messages where required, and maintain your National DNC subscription and scrub processes. Vatengi does not scrub numbers on your behalf. Inbound replies are logged for your workspace; you are responsible for reviewing and honoring opt-out requests promptly.
6. CRM integrations and exports
Data exported or synced to CRMs and other systems remains subject to this AUP. You are responsible for downstream use by your organization and subprocessors. Do not transfer Directory Data to parties that will use it unlawfully.
7. Monitoring and enforcement
We may monitor use of the Service to enforce this AUP, protect users and data subjects, and comply with law. Violations may result in warning, suspension, termination, or referral to authorities. We are not obligated to monitor all activity but reserve the right to do so.
8. Reporting abuse
To report suspected violations, contact compliance@vatengi.com. Data subjects may use our opt-out form or privacy request form.
9. Relationship to other agreements
If this AUP conflicts with the Terms, the Terms control except where this AUP imposes stricter use requirements, in which case the stricter requirement applies to your use of Directory Data and outreach features.
10. Changes
We may update this AUP by posting a revised version with an updated effective date. Continued use of the Service after changes constitutes acceptance where permitted by law.
